CHANGING WORLDS LIMITED BOOKING CONDITIONS dated 2/11/2005
1. AGREEMENT
Places are offered by Changing Worlds on the understanding that the Applicant has read, understood and agreed to abide by the following booking conditions. English law governs the Applicants agreement with Changing Worlds.
2. PRICE OF A PLACEMENT
The price quoted and which the Applicant has written on his/her Application Form includes all UK Selection and Briefing Events, UK and overseas administration, return airfare and travel to the placement. Some placements include the cost of accommodation or food. Where food and accommodation are not provided Changing Worlds will give Applicants an approximate cost. Occasionally our prices and departure dates can change (see “Surcharges”, paragraph 12.)
If the Applicant applies for a placement departing within 6 months Changing Worlds reserve the right to pass on any additional costs of the late booking of flights on to the Applicant. Alternatively Changing Worlds may require the Applicant to book his or her flight and will offer the Applicant a reduced price.
The Applicant will be responsible for arranging and paying for the cost of obtaining visas, inoculations, personal insurance, UK travel costs and return to the airport in country. The Applicant is also responsible for all independent travel costs.
3. PAYMENTS TO CHANGING WORLDS
On receiving a written offer of a place he/she shall pay the first instalment of £180.
The second instalment of £450 will be payable 9 months prior to departure.
The balance and final payment of the placement fee is payable not later than 70 days prior to the departure date.
4. INSURANCE
Before the Applicant departs for the placement he/she must be covered by travel insurance which must give adequate cover for medical expenses and the cost of repatriation and covers cancellation by Changing Worlds within 14 days of departure should the Foreign Office advise against travel (see ‘Cancellation by Changing Worlds’ below). The Applicant is advised to take out Personal Travel Insurance cover as early as possible in case he/she needs to withdraw for an insured reason such as death or injury of themselves or a close relative.
Any claims must be directed to the insurers, although Changing Worlds will provide assistance in the event of any dispute in the validity of a claim. Applicants are required to meet any costs or shortfall of personal funds arising out of a claim and must accept that Changing Worlds will not lend money in any circumstances.
5. CANCELLATION BY APPLICANT
In the event of cancellation by the applicant the first and second instalments are non-refundable by Changing Worlds. However this is normally refundable under the Applicants own Personal Travel Insurance for cancellation with insurable reasons. The final instalment of the placement fee is only refundable to the extent that Changing Worlds can recover any payments disbursed on behalf of the Applicant. No refund will be allowed unless Changing Worlds has received written confirmation of the Applicants’ wish to cancel 30 days before the departure date.
6. CANCELLATION BY CHANGING WORLDS
Changing Worlds will not cancel your placement unless forced to do so by any unusual or unforeseen circumstances, such as the cancellation of flights into the destination country, war, civil or political unrest, terrorist activity, natural disasters, epidemics or any event amounting to force majeure. If such an event occurs 14 days before departure or more Changing Worlds will endeavour to place the Applicant in another Changing Worlds placement with similarities to the placement originally chosen and reserves the right to pass on any costs incurred. If cancellation occurs within 14 days prior to departure Changing Worlds will not be obliged to find an alternative placement and a refund will be limited to refunding such part of the placement cost that Changing Worlds is reasonably able to recover.
Applicants are advised to take out a travel insurance policy that covers cancellation within 14 days in the event the Foreign Office advises against travel. Changing Worlds can recommend such a policy. The alternative placement may be in a different country and at a different price. However, if an alternative placement is not acceptable to the Applicant, Changing Worlds’ liability is limited to refunding such part of the placement cost that Changing Worlds is reasonably able to recover. However this liability shall not extend to cover further or consequential losses as a result of a cancellation.
7. CHANGES TO THE PLACEMENT
If a placement should become unavailable either before departure or whilst the Applicant is on the placement we reserve the right to select an alternative and will keep the Applicant updated with our decisions. Changing Worlds reserves the right to sub-contract any of its obligations under this contract.
8. DISCIPLINE AND DISMISSAL FROM PAID OR VOLUNTARY EMPOLYMENT
Changing Worlds expects the highest standards of behaviour from its Applicants. Applicants should behave with respect and cultural sensitivity and are expected to maintain good relations with their hosts abroad. Changing Worlds and its representatives are entitled to expect the Applicant will behave as a responsible and mature young adult should.
Please note that in the very unlikely event that an Applicant is dismissed from their paid or voluntary job for whatever reason this ends their placement and Changing Worlds involvement with immediate effect. In such circumstances the Applicant will not be entitled to any reimbursement of monies paid and will meet all costs incurred.
9. SERIOUS MISCONDUCT
Changing Worlds reserves the right to withdraw any Applicant from their placement in cases of serious misconduct or contravention of the law of the host country. This includes behaviour that might endanger themselves or others and where serious damage is done to the relationship between Changing Worlds and the Applicants in-country hosts. In such circumstances the Applicant will not be entitled to any reimbursement of monies paid and will meet all costs incurred.
Where possible a written or verbal warning will be given by either the Changing Worlds representative or from the UK office before termination of a placement. The Applicant gives Changing Worlds permission to consult the Parent/Guardian of the Applicant in cases of a termination of a placement or any other serious incident.
10. THE CHANGING WORLDS IN COUNTRY REPRESENTATIVE
The Changing Worlds in country representative will be available to arrange assistance in cases of illness and other serious problems that cannot be dealt with by the Applicants' immediate hosts or the Applicant. The representative is a paid member of the Changing Worlds staff and in all cases undertakes the role in addition to their normal employment. Much of their work takes place preparing for the arrival of the Applicants. They are there to act as a helpful friend to the Applicant (rather than a traditional package holiday representative) guiding them through a problem rather than automatically solving the problem for the Applicant. The representative will make regular contact with each Applicant and be contactable throughout their placement. The Applicant must inform the representative as early as possible if he/she has received a disciplinary warning of any kind from his/her employer so that the representative can offer advice. The Applicant must also notify the representative of any wish to extend the length of the placement or if the Applicant wishes to terminate the placement prematurely.
11. FINANCIAL SECURITY
All flight tickets will be purchased from reputable travel agents holding a valid Air Tour Operators Licence (ATOL) that protects the customer from the insolvency of the airline or the travel agency. All monies paid to Changing Worlds are protected by “Tour organiser failure insurance” (organised through Global Travel Insurance Limited 01903 203933) in the event of Changing Worlds going into bankruptcy or liquidation. 12. COMPLAINTS
If at any time the Applicant feels that he/she has grounds for legitimate complaint, he/she should raise the matter immediately with the Changing Worlds in country representative who will attempt to set the matter right. If the Applicant then feels the matter has not been resolved within a reasonable time period he/she should inform a Director of Changing Worlds in the Changing Worlds UK office at the earliest possible time by telephone or email. All complaints, which are not cleared to your satisfaction, should be notified to us within fourteen days after your return to the UK. Changing Worlds will not be responsible for any complaint arising from:
a. any action attributable to the Applicant
b. any action attributable to a third party
c. Unforeseen and unavoidable events beyond our control, such as war, civil or political unrest, strikes, terrorist action, government action, natural disaster or force majeure.
If Changing Worlds are found liable for damages in respect of our failure to carry out this contract, the amount of damages will be limited to the price of the placement.
13. SURCHARGES
Changing Worlds will absorb the cost of up to 10% of any increase in the direct cost of the placement due to increases in airfares, unfavourable changes in the exchange rates or if government action requires it. We reserve the right to impose surcharges in excess of 10% of any such increase up to 6 weeks before departure date. If we have to impose a surcharge in excess of 20% of the direct cost of the placement, the Applicant has the right to cancel his/her placement and claim a full refund less insurance charges.
